A temporary order can significantly affect finances, property, personal conduct, or family arrangements while a case remains pending. Several review procedures may be available, but the correct method depends on the order and the reason for the challenge.

Reconsideration Requires Something New

A party may seek reconsideration based on new or different facts, circumstances, or law. A renewed request may also be available when an earlier application was denied or conditionally granted.

Reconsideration is not simply an opportunity to repeat the same argument because the party dislikes the result. The requesting party must satisfy the applicable procedural requirements.

Set-Aside Relief Addresses Specific Problems

A temporary order may sometimes be challenged because it was entered through mistake, inadvertence, surprise, or excusable neglect. Extrinsic fraud may provide another potential basis for relief.

The evidence should connect the claimed problem to the party’s inability to participate fairly or present the issue. A general assertion that the order is unfair may not be sufficient.

Appeal or Extraordinary Review May Be Available

Certain temporary orders may be directly appealable, including qualifying orders involving injunctions, property restraints, support, fees, or custody. In other situations, a party may consider extraordinary appellate review.

Availability does not mean that appellate review will be quick or practical. The type of order, timing, available record, and harm created by delay all require evaluation.

The Existing Order Remains Binding

Filing a challenge does not ordinarily suspend the order by itself. The parties must continue complying unless the order is stayed, modified, vacated, terminated, or otherwise changed through an authorized process.

Private disagreement, an intended appeal, or a pending reconsideration request does not create permission to disregard the court’s directives.

A California family-law attorney can identify the proper review procedure, preserve the hearing record, seek a stay when legally available, and present the facts required to challenge the temporary order.
