California generally requires equal division of the community estate. A narrow exception may apply in a low-asset case when one spouse cannot be located despite reasonable efforts, allowing the court to award the entire community estate to the available spouse on appropriate conditions.

The Exception Applies Only to a Small Estate

The net community estate must be worth less than $5,000. Net value generally requires looking at community assets together with the liabilities included in the estate.

The exception is not a general shortcut for obtaining more property because the other spouse fails to participate. When the estate exceeds the qualifying amount, the ordinary property-division rules continue to apply.

Reasonable Diligence Is Required

The requesting spouse must show that the other party could not be located despite reasonable efforts. The court may examine the searches, inquiries, addresses, communications, and other steps taken to find that person.

Simply losing contact or receiving no response may not be enough. The evidence should allow the court to determine that the absence continued after meaningful attempts to locate the spouse.

The Court Retains Discretion

Even when the estate falls below the threshold and the missing spouse cannot be found, an award of the entire estate is not automatic. The court may impose conditions it considers appropriate.

The requesting spouse should accurately disclose all community assets and debts. Concealing property or undervaluing the estate can undermine the request and create later enforcement or set-aside issues.

Service and Property Division Are Separate Questions

Difficulty locating a spouse also raises questions about how the case may proceed and what notice is required. Satisfying an authorized service procedure does not necessarily establish every fact required for the low-asset property exception.

Existing orders and ownership rights remain effective unless changed through the court process. The available spouse should not take or transfer disputed property solely because the other person is absent.

A California divorce attorney can document reasonable search efforts, calculate the net community estate, complete the required notice process, and request an appropriately conditioned property award.
