A divorce petition should contain matters properly raised in the proceeding. When it includes material that does not belong there, the responding spouse may ask the court to strike that material. This remedy exists, but its timing and strategic consequences require careful consideration.

A Motion to Strike Targets Improper Matter

A motion to strike asks the court to remove material that should not appear in the petition. It does not decide every disputed issue in the divorce or replace the responding spouse’s need to address the petition properly.

The request should identify the particular matter being challenged and explain why it is improper. A general objection to the petition or disagreement with the petitioner’s factual position is not necessarily a reason to strike language from the pleading.

The Request Must Be Made Promptly

The responding spouse must bring the motion within the period allowed for filing a response. Waiting beyond that period may eliminate the availability of this procedural challenge.

Because the response deadline may also affect other objections, the spouse should evaluate all potential pleading and jurisdictional issues together. Filing one motion without considering its effect on other available objections can create unintended consequences.

Filing the Motion Constitutes a General Appearance

A motion to strike constitutes a general appearance in the case. That can be important when the responding spouse may also have objections involving personal jurisdiction, service, or the forum in which the case was filed.

A party should not assume that challenging language in the petition is procedurally neutral. Asking the court to strike material may confirm the party’s participation in the proceeding and affect other preliminary defenses.

The Cost May Exceed the Practical Benefit

Although the remedy is available, motions to strike are rarely used in family-law proceedings because the time and expense may exceed their practical value. Many disputed allegations can instead be denied in the response and addressed through evidence, temporary-order proceedings, settlement, or trial.

The decision depends on the importance of the challenged material and whether leaving it in the petition could materially affect the case. Irritating, exaggerated, or disputed language does not always justify a separate motion.

A California divorce attorney can evaluate whether the petition contains legally improper matter, preserve applicable preliminary objections, and determine whether a motion to strike offers a meaningful strategic benefit.
